Two new proposed rules implement an April 15 presidential memorandum in which President Barack Obama requested the U.S. Department of Health and Human Services (HHS) develop standards that would require Medicare- and Medicaid-participating hospitals (including critical access hospitals (CAHs)) to preserve the rights of all inpatients to choose who may visit them. Special interest groups aren’t the only ones disputing the Center for Medicare & Medicaid Services’ (CMS) vision of “meaningful use” as defined in the government agency’s Electronic Health Record Incentive Program Proposed Rule (42 CFR parts 412), released in January. An AAPC article in EdgeBlast No. 146 reported on how 96 various specialty and state medical associations recently sent a letter to CMS stating their case for why Stage 1 of the electronic health record (EHR) incentive program is too aggressive. Since then, the offices of CMS and Health and Human Services (HHS) have been bombarded with letters from Congress.

The Centers for Medicare & Medicaid Services (CMS) is instructing all of its Medicare contractors not to evaluate or enforce the supervision requirements for therapeutic services provided to outpatients in critical access hospitals (CAHs) from Jan. 1 to Dec. 31 this year. Read more »

Two new HCPCS Level II codes allow qualifying physicians and hospitals to be reimbursed for kidney disease patient education services provided to Medicare patients in 2010.
Effective Jan. 1, kidney disease patient education services are a covered Medicare benefit for patients with Stage IV chronic kidney disease (CKD), as indicated in the medical record by a severe decrease in the glomerular filtration rate (GFR) to that of 15-29 mL/min/1.73 m². A referral from the physician managing the patient’s condition should also be obtained and documented.

A provision in the Medicare Improvements for Patients and Providers Act (MIPPA) of 2008 will soon change the policy of who is considered a critical access hospital (CAH) outpatient when outpatient clinical diagnostic laboratory services are provided.

As of Jan. 1, 2009, eligible originating sites for payment of telehealth services will include hospital-based or critical access hospital-based renal dialysis facilities (including satellites), skilled nursing facilities and community mental health centers. This amendment to the Social Security Act is mandated by the Medicare Improvements for Patients and Providers Act (MIPPA) of 2008. Read more »
