HIPAA Mandates PHI Breach Notification

Health care providers, health plans, and other entities covered under the Health Insurance Portability and Accountability Act (HIPAA) will soon be required to notify individuals in the event their unsecured personal health information (PHI) is breached. The U.S. Department of Health and Human Services (HHS) published an interim final rule with comment period Aug. 24 providing new regulations regarding the HIPAA notice of breach requirements. The Mayo Clinic recently joined the growing number of providers, facilities, payers, and internet providers keeping and managing personal medical records on the internet. Advocates for Web-based personal health records (PHR) say the technology is more cost-effective and reduces medical errors.

Portability Issues Give PHRs a Rocky Start

Dave deBronkart, a 59-year-old kidney cancer survivor, was intrigued by the ability to read and edit his medical records but nothing prepared him for what he saw in his own Google Health personal health record (PHR). According to a Boston Globe article, the medical records deBronkart transferred from Beth Israel Deaconess Medical Center to Google Health said his cancer had spread to either his brain or spine and listed several other conditions he had, unbeknownst to him. His blood pressure medication also required “immediate attention,” much to his surprise.

Mom, Son Charged in PHI Thefts

A Long Island mother and son are charged with stealing patient information in New York and Florida and using that information to get credit cards. Some alleged victims were deceased.

The mother, who worked in a physician’s office and had access to personal health information, and her son, a painter, are charged with three counts of second-degree identity theft, first-degree scheming to defraud, third-degree assault, and fourth-degree crminal possession of a weapon. Read more »

CMS Presses On with PHR Program

CMS is expanding its South Carolina personal health record (PHR) pilot program with TRICARE health data. The addition eases access to health data for Medicare beneficiaries.

Original Medicare beneficiaries who also received TRICARE benefits now have the option of adding the TRICARE health data to their MyPHRSC personal health records. Until now, the data has only been available through the Department of Defense systems. Read more »
